These Terms and Conditions replace all other Terms and Conditions These terms apply to your order. We may change our terms and conditions at any time, so please do not assume that the same terms will apply to future orders.

Law
These terms and conditions are governed and shall be interpreted in accordance with UK Law. These Terms and Conditions are written in the English language and all notices and communications shall be in the English language. In the event that these Terms and Conditions are translated into another language, the English language text shall prevail.

Prices
All prices are shown in £GBP and include VAT.  The price paid will be the advertised price at the time of your order and will be shown on your invoice which will be emailed to you as part of our confirmation. The advertised price of any product may be changed by us at any time.  We will do our best to ensure that the correct prices are displayed on our website, however, should an error become apparent and a products’ correct price is higher than that stated on your order we reserve the right to inform you and you can then choose to pay the additional amount and proceed with the order or cancel and receive a refund of any money paid in respect of that order.

Payment
Once we download your order onto our system we take payment, information provided on your order is then checked by a member of staff and should any discrepancies be found you will be contacted.  You undertake that all details provided by you in order to facilitate the processing of your order by us will be true and accurate.  We may take steps to validate and/or verify the authenticity of payment details prior to fulfilling your order.

We are happy to take payment by sterling cheque and goods will be released for despatch once the cheque has been cleared.  If you require an Invoice prior to making payment please contact us.

Madfun Ltd accept the following cards for payment: Mastercard, Visa, Switch, Solo, Visa Delta, Maestro or Electron.  Paypal is also accepted.

We reserve the right the refuse to accept any order placed by you.

Availability & Product Descriptions
All products on our website are subject to availability.   If a product is unavailable we reserve the right to offer a substitute product of equivalent value, specification and price .  In the event that a suitable alternative is not available,  we will notify you as soon as possible and refund any payment made in respect of that item.  Manufacturers periodically update their products and we reserve the right to supply these even if pictures and descriptions may vary from that listed on our website.

Cancellations & Returns
You have the right to cancel the contract within seven working days from the day after your goods have been received.

You must inform us in writing either via post, or, ideally the cancellation notice should be sent by e-mail to MadFun Ltd at cancel@madpools.co.uk and must state your name, a description of the goods concerned and the order number of the cancelled contract. Attaching the Order Confirmation MadFun Ltd originally sent you will also assist MadFun Ltd in processing your cancellation and refund as quickly as possible. If this cancellation arrives before your goods are despatched you will receive a full refund. If however your goods have been despatched there will be a charge to cover the cost incurred by us to despatch them or £19.99, whichever is the higher.

You must take reasonable care of the goods and then return the goods to MadFun Ltd by registered post or similar as soon as it is practicable to do so. You are responsible for the cost of returning the goods to MadFun Ltd and the risk of damage to the goods in transit. We request that you return the goods with the original packaging. Self-assembly items cannot be returned if assembly is part or fully completed unless the item is faulty.  Refunds will be processed within 30 Days.

Liability
We promise that for any product you purchase from our website that we have the right to sell the product to you and that the product will be of satisfactory quality.

We also promise that any product we provide to you will be provided with reasonable skill and care.  Subject to our delivery statements, we shall not be liable for any delay or inability to perform our obligations to you if such delay is due to any cause whatsoever beyond our reasonable control.  We exclude all other express or implied terms, conditions warranties, representations or endorsements whatsoever with regard to any products (including without limitation the Products), our website or any information or product provided through the website.  If we are liable to you for any reasons, our liability will be limited to the amount paid by you for the product concerned.  This limit does not apply to any liability we may have for death or personal injury resulting from our negligence or for our fraudulent misrepresentation.  The limitations and exclusions in this clause do not affect your non-excludable statutory rights and only apply to the extent permissible by applicable law.

Faulty Items
In the unlikely event that the product arrives damaged or faulty we request that you notify us by email with supporting photographic evidence of the damage or fault to sales@madpools.co.uk.

We reserve the right to make changes or corrections, alter, suspend or discontinue any aspect of our website or the content at any time and without notice.  Although we will do our utmost to ensure that website content is accurate please be aware that it may contain typographical errors and/or other inaccuracies.
